1. Scope
These General Terms and Conditions (“Terms”) apply to all orders placed through our online shop lisa-eleni.com. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
Any deviating, conflicting or supplementary terms of customers do not form part of the contract unless we expressly agree to their application.

3. Conclusion of the contract and correction options
The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
You may initially place products in the shopping cart without obligation and may correct your entries at any time before submitting the binding order by using the correction tools provided during checkout.
By clicking the order button, you submit a binding offer to purchase the goods in the shopping cart. The contract is concluded when we confirm your order by email or dispatch the goods, whichever occurs first.
Immediately after submitting the order, you will receive an email containing the order details. Please check all information carefully, in particular the billing and delivery addresses, email address, products, sizes or variants, and payment method.
We reserve the right to reject or cancel orders where legally permissible, in particular in the event of obviously incorrect information, abusive orders, technical or pricing errors, or unavailability. Any payments already made will be refunded without undue delay.
4. Contract language and storage of the contract text
The language governing the conclusion of the contract is German. Any information additionally provided in English is intended to aid understanding.
After conclusion of the contract, we do not permanently store the contract text in a form accessible to you through our online shop. You will receive the order details, these Terms, the cancellation policy and other relevant contractual information with the order confirmation by email.
The current version of these Terms can be viewed, saved and printed on our website at any time.
5. Products, product presentation and availability
We make every effort to present our products, materials, sizes, dimensions, colours and other characteristics as accurately as possible. Minor variations, particularly in colour, shine, perceived size or on-screen presentation, may occur due to different devices and display settings.
Product descriptions, images, measurements and notices are intended to help you select and inspect products before purchase. Please pay particular attention to information on size, material, method of wear and compatibility for earrings and piercings.
All products are available only while stocks last. If an ordered product is unavailable, we will inform you without undue delay and refund any payment made for that product.
6. Prices, taxes and shipping costs
Prices shown in the online shop are displayed in the currency applicable to your delivery country or market selection and include statutory VAT where applicable.
Shipping charges, express surcharges or charges for special delivery methods may apply in addition to product prices. The methods, delivery times and costs available for your delivery country are shown during checkout and on our shipping page.
Promotions, discount codes and vouchers may be limited in time or quantity. The conditions stated for the relevant promotion apply. Unless expressly stated otherwise, discount codes cannot be applied retrospectively to completed orders.
7. Delivery, shipping and transit risk
We deliver by shipment only. Collection in person is currently not available.
Delivery is made to the address entered during checkout. Please ensure that it is complete and correct. We are not responsible for delays or costs caused by incomplete or incorrect address details unless the error is attributable to us.
Unless expressly confirmed as binding, delivery times are estimates. Delays may occur due to carriers, customs clearance, force majeure, strikes, exceptional weather or other circumstances beyond our control.
Transit risk: We hand the goods to the carrier properly packaged. Statutory rules on the transfer of risk apply to consumers. As a rule, the risk of loss or damage during transit therefore passes to you only when you, or a third party designated by you other than the carrier, take possession of the goods.
If, as an exception, you commission a carrier that was not named or offered by us, the risk passes to you upon handover to that carrier to the extent permitted by law.
If you issue a safe-place authorisation, redirection, instruction to leave the parcel at a particular location, or similar delivery instruction, delivery may be deemed completed under the carrier’s terms. Please review such instructions carefully.
8. Undeliverable parcels and refusal of delivery
If a parcel is returned for reasons attributable to you, for example an incorrect or incomplete address, failure to collect, refusal of delivery or failure to cooperate with delivery, we may charge you the additional shipping and return costs actually incurred or offset them against a refund, to the extent permitted by law.
Your statutory rights, including warranty rights and any statutory right of withdrawal, remain unaffected.
9. Payment
The payment methods displayed at checkout are available. Individual methods may be restricted or unavailable depending on the country, shopping cart, credit assessment or technical availability.
Credit card
You enter your credit card details during checkout. Your card is charged in connection with completion of the order or in accordance with the payment provider’s terms.
PayPal
When paying with PayPal, you may be redirected to PayPal’s website or payment interface. You must be registered or register with PayPal, authenticate yourself and confirm the payment instruction. PayPal’s terms also apply to payment processing.
Sofort / Klarna
When paying with Sofort or Klarna, you may be redirected to the relevant provider’s payment interface. An online-banking-enabled account and appropriate authentication may be required. Further information is provided during checkout.
Google Pay
To pay with Google Pay, you must be registered with Google, have activated Google Pay and confirm the payment using your credentials or the designated authentication method.
Apple Pay
To pay with Apple Pay, you must have activated Apple Pay and confirm the payment using the designated authentication method. Further information is provided during checkout.
EPS
To pay using Electronic Payment Standard (EPS), you need an online-banking-enabled account with a participating Austrian bank. Further information is provided during checkout.
Klarna payment methods
In cooperation with Klarna, additional payment methods may be offered where available at checkout. Use may be subject to successful identity and credit checks. Klarna’s terms and privacy notices also apply.
Instalment purchase / payment by instalments
Where available at checkout, instalment options may be offered through Klarna, Mollie or other payment providers. Availability, conditions, terms, minimum instalments and requirements are set out at checkout and in the relevant provider’s terms.
Shop Pay
When using Shop Pay, you may use delivery and payment information stored with Shopify or Shop Pay. You confirm payment through the Shop Pay interface. The terms of Shop Pay, Shopify or the relevant provider also apply.
10. Retention of title
The goods remain our property until payment has been made in full.
11. Right of withdrawal, returns and return shipping
For orders with a delivery address in Austria or Germany, you may declare your withdrawal within 14 days after receiving the goods. Further details are set out in our cancellation policy.
You may exercise your right of withdrawal using our online “Cancel contract” function, by emailing info@lisa-eleni.com, or by any other unequivocal statement. Use of the model cancellation form is optional.
After declaring withdrawal, the goods must be returned without undue delay and no later than 14 days thereafter. Dispatch before expiry of the period is sufficient.
Exchanges and return shipping costs
Exchange: If you ordered the wrong size or wish to exchange an item for another size or another piece of jewellery, we provide a free return label. Any price difference will be charged or refunded accordingly.
Partial return: If you retain at least one item from the order and return only part of it, we provide a free return label.
Complete return: If you return the complete order and retain no item, you bear the return shipping costs. You may use our return label; in this case we deduct €10 from the refund. Alternatively, you may send the return independently with sufficient postage.

Please enclose a short note with your name and order number so that we can identify the return.
We may withhold reimbursement until we have received the goods back or until you provide evidence that you have sent them back, whichever occurs first.
In the event of an effective withdrawal, we reimburse all payments received from you, including the cost of the least expensive standard delivery offered by us. Additional costs resulting from a more expensive delivery method chosen by you are not reimbursed. We use the same payment method for reimbursement as was used for the original transaction unless expressly agreed otherwise.

12. Condition of the goods, inspection and diminished value
Please handle the goods carefully and return them as complete as possible, securely packaged and, where possible, in their original packaging.
You are liable for any diminished value only where it results from handling beyond what was necessary to establish the nature, characteristics and functioning of the goods.
We inspect every return carefully. If an item has been damaged, bent, scratched, worn, inserted or used beyond ordinary inspection, an amount reflecting diminished value may be deducted. This applies in particular where the item can no longer be sold as new.
For hygiene reasons, please do not insert or wear earrings, hoops, studs or piercings if you intend to return them. Please assess size, shape and appearance using the product images and measurements or by holding the jewellery externally against the intended position.
These notices do not restrict your statutory right of withdrawal. They relate only to inspection of the condition of the goods and possible diminished value after return.

13. Damage in transit
If goods arrive with obvious transport damage, please report it to the carrier where possible and contact us without undue delay at info@lisa-eleni.com.
Failure to make a report or contact us does not affect your statutory claims or their enforcement, including warranty rights. It does, however, help us pursue claims against the carrier or transport insurer.
14. Damaged, defective or incorrect items
If you receive a damaged, defective or incorrect item, please contact us as soon as possible at info@lisa-eleni.com and, where possible, include photographs and your order number. We will review the matter individually.
Your statutory warranty rights remain unaffected.
15. Warranty rights and voluntary guarantees
Statutory warranty law applies. For movable goods supplied to consumers, the statutory warranty period is generally two years.
Any additional voluntary guarantee exists only where it is expressly identified as a guarantee for the relevant product or on a separate information page and its terms are described. A voluntary guarantee does not restrict statutory warranty rights.
16. Liability
We are liable for damage in accordance with applicable law.
In particular, liability is unlimited for injury to life, body or health, for damage caused intentionally or through gross negligence, for claims under product liability law, and within the scope of any guarantee expressly assumed by us.
For a slightly negligent breach of essential contractual obligations, we are liable in accordance with applicable law. Essential obligations are those whose performance makes proper execution of the contract possible and on whose fulfilment customers may regularly rely.
Otherwise, liability is excluded or limited only to the extent permitted by law. Mandatory consumer rights remain unaffected.
17. Customer account and login details
If a customer account is offered and used by you, you must keep your login details confidential and protect them from unauthorised access. Please inform us without undue delay if you suspect misuse of your account.
You are responsible for keeping account details current and correct, in particular your email, billing and delivery addresses.
18. Use of the online shop and prohibited uses
You may use our online shop and its content only lawfully. In particular, you must not infringe third-party rights, impair the shop’s technical security or availability, cause abusive automated access, or provide false or misleading information.
Where there are reasonable grounds to suspect abuse, fraud or infringement, we may technically restrict abusive access and block, reject or cancel orders or accounts to the extent permitted by law.
19. Intellectual property and content
All online-shop content, including text, images, graphics, product photographs, logos, designs, videos and product descriptions, is protected by copyright or other rights.
Unless permitted by law, such content may not be used, reproduced, modified, communicated to the public, distributed or otherwise exploited without our prior consent.
20. Reviews, feedback and submitted content
If you submit reviews, feedback, photographs, text or other content, please ensure that you are entitled to do so and do not infringe third-party rights.
To the extent permitted by law, we may use submitted feedback and reviews to process your request and improve our offering and, where there is an appropriate consent or other legal basis, display them in our online shop or communications.
We may decline to publish or remove unlawful, abusive, misleading, manifestly false or promotional content, or content that infringes third-party rights.
21. External links and third-party services
Our online shop may contain links to third-party websites or services, including payment providers, carriers, social-media platforms or embedded functions. The relevant providers are responsible for the content, availability, privacy and terms of external services.
When you use external websites or services, their terms and privacy notices also apply.
22. Relationship with Shopify
Our online shop is operated using Shopify’s technical platform. However, Lisa Eleni KG alone is the contracting party for purchases. Shopify is neither the seller of our products nor a party to the purchase contract between you and Lisa Eleni KG.
Certain payment, shop, account or convenience functions may be provided by Shopify or associated services. Where these services are used, their terms and privacy notices may apply additionally.
23. Privacy
Information about the processing of personal data is available in our privacy policy.
24. Errors, technical availability and changes to the shop
We endeavour to keep our online shop accurate and continuously available. Nevertheless, technical disruptions, maintenance, display or typographical errors, pricing errors or other inaccuracies may occur.
Obvious input, writing, calculation or pricing errors entitle us, to the extent permitted by law, to correct, reject or cancel an order. Any payments already made will be refunded without undue delay.
We may change, update or remove content, functions, products and presentations of the shop to the extent permitted by law.
25. Applicable law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, mandatory consumer-protection provisions of that country remain unaffected.
26. Jurisdiction
The statutory place of jurisdiction applies to consumers.
27. Changes to these Terms
The current version of these Terms is available on this page. The version available when you place your order applies to that order unless mandatory law provides otherwise.
Where required, we will communicate material changes in an appropriate manner.
